Definitions

"Service" includes the Versatiley website and any Versatiley products, software, data feeds, and services provided to you on, from, or through the Versatiley website.

"Content" includes the text, software, scripts, graphics, images, photos, logos, icons, tiles, avatars, audio files, sounds, music, videos, audiovisual combinations, interactive features and other materials you may view on, access through, or contribute to the Service.

"Cosmetics" are virtual goods, namely smiley skin sets and edit mode auras.

Agreement and changes

By using or visiting the Service, you signify your agreement to these Terms of service, and Versatiley's Privacy policy, found at https://www.versatiley.com/privacy/. If you do not agree to any of these terms or policies, please do not use the Service.

Although we may attempt to notify you when major changes are made to these Terms of service, you should periodically review the most up-to-date version. Versatiley may, in its sole discretion, modify or revise these Terms of service at any time, and you agree to be bound by such modifications or revisions.

Submitting Content

By submitting Content to Versatiley, you grant Versatiley a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license, without compensation, to use, reproduce, distribute, prepare derivative works of, display, and perform the Content in connection with the Service, for an unlimited time throughout the world on the internet, on TV or any other medium. Thus you give Versatiley the right to use, copy, present, reproduce, display, edit, integrate, license as well as distribute the Content which you have created, for both commercial and noncommercial use.

You also grant each user of the Service a non-exclusive license to access your Content through the Service, and to use, reproduce, distribute, display and perform such Content as permitted through the functionality of the Service and under these Terms of service.

Any suggestions about graphic or game design you tell us are assumed to be offered for free unless otherwise agreed before the suggestion was made. If you have any ideas, feel free to contact us.

The above licenses granted by you in Content you submit are perpetual and irrevocable.

Versatiley reserves the right to remove Content without prior notice.

Using Content

You may not use any of Versatiley Content outside of the Versatiley website. With two exceptions, mentioned below. This means that you may not copy, distribute, sell, publish, send or otherwise recirculate Versatiley material to a third party without the written consent of Versatiley. You may not change, revise or replace any of the material found in the game or website, either in its entirety or parts thereof. This includes making and/or distributing alternative clients that connect to the Versatiley server or an alternative server.

The two exceptions are:

1. Most content of Versatiley has a Creative Commons license. We keep a listing of that content, found at https://www.versatiley.com/CC/.
2. If you are making a recording or text about Versatiley, such as a blog or vlog or live-stream, we do not mind fair use of our Content.

Community rules

In order to establish a welcoming environment for all players, there are rules in place that everyone must follow.

Unlawful acts are prohibited.

Do not create/send Content that:

• is illegal.
• contains references to the drug use, sexual acts, nudity or intense violence.
• contains swearing at others or bypasses the word filter.
• discriminates other people based on their religion, race, sex or gender, political beliefs, age, sexuality, or anything else.
• incites harm against people or encourages others to do so.
• contains others' personal or confidential information.
• impersonates someone in a misleading or deceptive manner.

(The rules above apply to all Content you submit to Versatiley including chats, sign text and even tiles.)

Also do not:

• attempt to hack or interfere with the normal use of Versatiley using external software ("bots").
• bypass bans by using more than one account.
• abuse the reporting system.
• spam or harass others.

Please report players who break the rules stated above, and explain the situation as detailed as you can.

Terms of sale

You may purchase Cosmetics. Your purchase grants you only the right to use them with this Service. You will receive purchased Cosmetics no more than two business days after the payment is completed and Versatiley has been notified by our payment provider(s).

Versatiley only uses third party payment providers and therefore does not store any credit card or bank account information. The payment providers fully live up to international industry security standards. All credit card and bank account information is stored by the payment providers solely in encrypted form in a high security data center. All collection and storage of sensitive information by the payment providers conforms to the requirements of the General Data Protection Regulation and fully obliges to all international security standards.

If you buy Cosmetics, you lose any refund rights you may normally be entitled to when the Cosmetics are made available to you. (Per the Exceptions of Guarantees and returns in the EU.) We may do exceptions at our sole discretion. If you need to dispute a purchase you can contact Versatiley.

If you are under 18 years of age or do not pay your own bills, you must get permission from your parents, the person who pays your bills, the cardholder or the person paying, before making any Versatiley purchases with that card. If you make any unauthorized payment on Versatiley - regardless of payment method - your account will be permanently deleted and your IP may get blocked! Also, if you do not abide by the Versatiley Terms of service, your account may be terminated and you will lose any Cosmetics your profile may have.

Legal matters

Nothing in these Terms of service shall be deemed to confer any third-party rights or benefits.

These Terms of service will be governed and interpreted according to the laws of the Netherlands. You specifically consent to personal jurisdiction in the Netherlands in connection with any dispute between you and Versatiley arising out of these Terms of service or pertaining to the subject matter hereof. The parties to these Terms of service each agree that the exclusive venue for any dispute between the parties arising out of these Terms of service or pertaining to the subject matter thereof will be in the courts in the Netherlands. Likewise, if you seek to file a legal claim against us, you agree to file and resolve it exclusively in a court located in the Netherlands.

If there's anything legal you're wondering about that isn't answered from this page, don't do it, ask us about it.

Versatiley has the right to close your account if you violate this agreement or the rules of Versatiley or if you have not used your account for four months.

TO THE FULLEST EXTENT PERMITTED BY LAW, VERSATILEY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES AND YOUR USE THEREOF. YOU SPECIFICALLY ACKNOWLEDGE THAT VERSATILEY SHALL NOT BE LIABLE FOR CONTENT OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.
